Full House Resorts received an opportunity for an extension of time for development of its permanent Waukegan casino from the Illinois General Assembly as it awaits a court decision involving the state, city and the Forest County Potawatomi Community.
From the time Full House opened the Temporary by American Place in February, it had two years to open the permanent American Place Resort and Casino. It received permission from the Illinois Gaming Board to begin the project in December 2021.
On the same day Full House got the go ahead from the gaming board nearly two years ago, Cook County Judge Cecilia Horan dismissed a Potawatomi lawsuit against the City of Waukegan and the State of Illinois trying to stop the board’s proceedings.
Around the time Full House presented its site plan for the permanent resort to the Waukegan Planning & Zoning Commission in August, it learned Illinois’ 1st District Appellate Court reversed Horan’s decision and Full House paused its plans.
Now Full House can ask the gaming board to give it another year to operate its temporary facility while it completes plans, builds and opens its luxury gaming resort adjacent to the short-term casino near the Fountain Square Shopping center.
The Illinois General Assembly overwhelmingly approved legislation Nov. 9 in Springfield giving Full House the right to seek permission from the board for an extra year to open the permanent casino as long as it has a sound reason.
“We will approach the Illinois Gaming Board for an extension,” Alex Stolyar, Full House’s senior vice president and chief development officer, said Monday. “We aren’t sure exactly when.”
As long as Full House can show the board “good cause” why it needs more time to complete its plans and begin construction, it can get an extra year “or another period of time deemed necessary,” according to the language of the new law.
The legislation awaits Gov. J.B. Pritzker’s signature. Jordan Abudayyeh, the governor’s deputy chief of staff for communications and media strategy, said Monday the bill has yet to reach the governor’s desk.
Stolyar said Full House, a publicly traded company, is not in a position to seek a loan for the project from a financial institution as long as the uncertainty posed by the litigation remains.
“We can’t get financing while the litigation is outstanding,” Stolyar said. “Everything is on pause until the litigation is resolved against the city and the state.”
When the Potawatomi community started its lawsuit against Waukegan and the gaming board in 2021, it wanted the court to stop the licensing procedure. Horan denied the request and later dismissed the case.
After the case was dismissed, the Potawatomi Community appealed and the appellate court ruled since there was still time to reconsider the issuance of the license because the current casino was temporary.
After listening to proposals from Full House, the Potawatomi Community, Midwest Gaming and North Point Casino in 2019, the Waukegan City Council voted to reject the Potawatomi bid sending the other three to the gaming board for consideration.
Stewart Weiss, an attorney for Waukegan Corporation Counsel Elrod Freedman, said the city and state appealed the appellate court ruling to the Illinois Supreme Court. He does not anticipate a decision whether the highest court will hear the case until January.
After nearly nine months of operations Stolyar said the casino’s business continues to show improvement. He hopes the third restaurant — North Shore Steak and Seafood — will open by the end of the year.
