IN STRICT accordance with the Anti-Terrorism and Effective Death Penalty Act of 1996, the Brooklyn U.
S. attorney has ordered gambling cruises to venture 12 miles from shore before the first set of dice can be thrown.
This being a free country, cruise-ship owners now have a choice. They can disregard the order and suffer the sanctions: up to two years in jail, hundreds of thousands of dollars in fines, seizure of their vessels.
Or they can go out of business.
Now you’d imagine the Anti-Terrorist Act would apply if the junkets had names like “Hezbollah Cruises,” “Party of God Parties” or “Hamas Hi-Seas Hijinx.
” Unfortunately, the only gambling boat in Brooklyn, Bay Cruises’ Liberty I, is owned by a guy named Kornblum.
And though he seems to have caused Rudolph Giuliani some consternation, even the mayor would be hard-pressed to call him a terrorist. All Michael Kornblum has done is build a business where there was a garbage-strewn lot.
In the process, he created 205 jobs, most of which are held by city residents. He has a $5 million payroll and spends $1.
5 million each year on local vendors like Lundy Bros. restaurant.
“Bay Cruises put people to work and cleaned up an area that was a disgusting blight,” said John Nikas, chairman of Community Board 15. “[Kornblum] worked with the community. He’s gone out of his way to clean the place up. You got jobs where you had garbage. Terrorists? God help us.
”
A 1994 amendment to the Gambling Ship Act allowed cruises to become gambling junkets once they were 3 miles off shore. But as the U.
S. attorney now interprets the 1996 Anti-Terrorism Act in splendid harmony with Giuliani’s recommendations the action can’t begin until the vessel is 12 miles from land.
Before the U.
S. attorney issued his order two weeks ago, Bay Cruises offered three five-hour trips a day. About an hour of that time was spent getting to and from the 3-mile line. With a 12-mile rule, the cruises need three hours of travel time. Now, Bay Cruises is already down to two daily trips. Soon, it could be none.
Do the math. With three hours of downtime on a five-hour cruise, Kornblum’s company needs a lot more than luck to come out a winner.
Only two places on the Eastern seaboard offer these so-called cruises to nowhere: Miami and Sheepshead Bay. The U.
S. attorney in Miami where tourism is like religion has yet to enforce the 12-mile rule. Only Zachary Carter has seen fit to invoke an anti-terrorist measure against an American capitalist.
Carter’s executive assistant, William Muller, offered no comment on the Miami prosecutor’s nondecision. All he said was, “What we did was in the consultation with the Department of Justice. That was the conclusion that the U.
S. attorney and the department arrived at.
”
Also, the mayor. The Giuliani administration hailed Carter’s order as “a terrific victory for the city.
” Officials said it would result in fewer gambling ships and make them easier to monitor.
The mayor is big on such monitoring. Maybe he has a problem with gambling. If so, he fails to comment on the fact that the biggest bookie in New York State is New York State. More likely, having been a U.
S. attorney himself, Giuliani is thinking gangsters. Here, he has a point. Let the gambling boats sink if they’re run by gangsters.
Kornblum isn’t a gangster anymore than he’s a terrorist. He’s just been treated like both.
Giuliani’s first reaction to the gambling ship was: “This, I think, is a good thing in the sense that it opens up New York City to competition.
”
Then he quickly changed his mind. Kornblum suspended operations for two weeks while he and his employes were subjected to all sorts of background checks conducted by the city Department of Investigation. You can bet if any dirt had been uncovered by DOI or, later, by the mayor’s Gambling Control Commission, Liberty I would have been left to rot at the dock.
Then last summer, Donald Trump’s lobbyists started making noise in Albany. As Trump owns Atlantic City casinos, he’s not a great fan of legalized gambling in New York.
Two years ago, it was Trump who took it upon himself to warn the citizenry of the grave social dangers that would arise from putting Quick Draw games in the bars. “Crime will go up,” he said. “Welfare rolls will skyrocket . . . ”
ANY MINUTE now, he’ll start going off on the threat of terrorists who dock their boats on Emmons Ave.
But don’t worry. Trump isn’t behind this 12-mile rule. He couldn’t have interfered, for as everyone knows, his days of late have been spent mourning that special woman he “never had the opportunity to court,” that “dream lady,” better known as Princess Diana.
